Jakarta – Indonesian Trade Union Congress Alliance Confederation (KASBI) Chairperson Nining Elitos has criticised President Joko "Jokowi" Widodo's policy of issuing a Government Regulation in Lieu of Law (Perppu) Number 2/2022 on the Job Creation Law.
"The government should [instead] issue a Perppu that revokes the Job Creation Law, not like now", Elitos told CNN Indonesia on Saturday December 31.
Elitos said that the benefits of the Job Creation Law have never been felt by the ordinary Indonesian people. She even said that the law has had a negative impact on the people.
In addition to this, the Job Creation Law has already been declared conditionally unconstitutional by the Constitutional Court (MK). Elitos questioned why the government did not follow the court's ruling that the Jobs Law must be revised within two years.
"All of a sudden at the end of the year a Perppu is issued that did not involve any public participation, moreover this is a manifestation of the government's own inconsistency, including ignoring the constitution", she said.
Earlier, Widodo issued a Perppu on the Jobs Law that revises a number of articles in the law.
Coordinating Minister for Security, Politics and Legal Affairs Mahfud MD said that at the same time the Perppu responds to the Constitutional Court's ruling. Thus he claimed that the law's conditionally unconstitutional status has now been annulled.
"Yes, (the Job Creation Law's conditionally unconstitutional status has been annulled). Look, conditionally unconstitutional means something is declared unconstitutional until certain conditions are fulfilled", said Mahfud at the Presidential office in Jakarta on Friday December 30. (dhf/arh)
